The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.61 dated 19.7.2015 registered for the offence under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Kiratpur Sahib, District Ropar.

Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

No.M-3514 of 2017 [2] From the record, I find that as per the FIR, the petitioner absented from the Court proceedings on 21.11.2016 as he was arrested in another case FIR No.202 dated 18.11.2016 and the Court issued nonbailable warrants against him. In pursuance of the order dated 3.2.2017 passed by this Court, the petitioner has already appeared before the trial Court and has been released on interim bail on his furnishing bail bonds. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the present case, I find that the absence of the petitioner from the Court is not intentional, therefore, I find merit in this petition and the same is allowed. The interim order dated 3.2.2017 passed by this Court granting interim bail to the petitioner is made absolute.
