Prayer has been made for placing on record the original compromise (Annexure A-3) and passing the order in accordance with Order 23 Rule 3 of the CPC.

Present Regular Second Appeal was filed against order passed by the appellate Court on 01.02.2002, whereby civil appeal against the judgment and decree dated 23.12.2000 was accepted and appeal was allowed.

Now on the basis of compromise (Annexure A-3) the order of first appellate Court dated 01.02.2002 stands modified in terms of the compromise (Annexure A-3) and said compromise is part of the decree. The civil misc. application as well as Regular Second Appeal stands disposed of.
