Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.300 dated 14.11.2014 under Sections 22 of NDPS Act, registered at Police Station Patti, District Tarn Taran. Notice of motion.

Mr.Deep Singh, Asstt. Advocate General, Punjab, has put in appearance on behalf of respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that 320 grams of intoxicating powder (Diphenoxylate Hydrocholoride) has been recovered from the present petitioner and the recovery from the petitioner falls under commercial quantity. Section 37 of the NDPS Act bars the grant of bail to the accused Vineet Gulati 2017.02.13 16:49 I attest to the accuracy and authenticity of this document Chandigarh in the case of commercial quantity.

CRM No.M-3519 of 2017 -2Therefore, finding no merit in the present case the same is dismissed.

However, as the petitioner is stated to have been in custody for the last more than 1 year and 7 months, therefore, the trial Court is directed to expedite the trial by giving short adjournments and if required, even day to day adjournments. The Investigating Officer/SHO concerned is directed to produce the witnesses before the trial Court at the earliest.
