A perusal of the police file indicates that the dispute is regarding the petitioner having obtained loan from the bank by duping complainant Surinder Kaur. The petitioner has already joined the investigation. It does not appear to be a case of custodial interrogation. Without prejudice to the rights of the bank to recover the amount due from the petitioner, the petition is allowed. It is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
