MADAAN Present:- Mr. Shiva Khurmi, Advocate for the petitioner. *** By way of filing the present petition, the petitioner, who is an accused in a criminal complaint titled Ram Dulari versus Mamta and another pending before Chief Judicial Magistrate, Ambala is challenging order dated 29.11.2016 vide which her application under Section 91 Cr.P.C. for calling documents has been declined.

I have gone through the impugned order. The trial Magistrate has observed that on putting in appearance in the Court, the accused have moved an application in question without explaining the relevancy thereof more particularly when the case is fixed for pre charge evidence. It has further been observed that the accused will have liberty to lead evidence at the time of their turn. The order is well reasoned one. I do not find any illegality therein which might have called for interference while exercising powers under Section 482 Cr.P.C. The petition stands dismissed accordingly.
