CR-2743-2026 Perusal of Annexure P7 would reveal that in RSA-2713-2019 titled Om Parkash Jain Vs. Hukam Singh and another, this Court had directed the parties to maintain status quo in respect of the disputed property. Learned counsel for the petitioner submits that as far as the present case is concerned, petitioner is not a party to the litigation between Om Parkash Jain and Hukam Singh. However, it is conceded by learned counsel, as was also conceded before the Trial Court that property in both the litigations is the same. Faced with the aforesaid situation, learned counsel for the petitioner makes a statement to withdraw the present petition with liberty to move an appropriate application before the executive/trial Court for refund of the amount as deposited by the petitioner, in accordance with law. In view of the aforesaid statement, the present petition is dismissed as withdrawn with liberty aforesaid. In case any such application is moved, the trial Court shall dispose of the same in accordance with law.
