The present petition has been filed under Section 482 Cr.P.C. for quashing of complaint case No. COMI/42 dated 30.04.2019 under Sections 323, 324, 325, 326, 450, 452, 295, 148, 149, 34 and 120-B of the Indian Penal Code (Annexure P-11) and the summoning order dated 19.03.2024 passed by Sub-Division Judicial Magistrate, Patti (Annexure P-18), whereby, the petitioners have been summoned to face trial under Sections 323, 324, 326, 452, 148 and 149 of the Indian Penal Code, 1860. 2.

After arguing vehemently on the merits of the case, learned counsel for the petitioners prays that all the issues raised by the petitioners during the pendency be kept open to be raised by them before the Court of competent jurisdiction and hence, prays for withdrawal of the present petition, however, prays that lenient view be taken qua petitioner Nos. 1 PARUL 2024.05.02 17:24 I attest to the accuracy and authenticity of this document and 2 keeping their age in consideration.

With the aforesaid liberty, the present petition stands dismissed as withdrawn with a direction to the trial Court that, in case, the petitioners put in appearance on the date fixed, the trial Court shall take a lenient view while considering the concession of bail if sought qua petitioner Nos. 1 and 2, considering their age. 4.

It is made clear that this Court has not expressed any opinion on the merits of the case and the liberty granted if any is only on the request of the counsel for the petitioners and is not a direction and the matter shall be proceeded in accordance with law.
