Copies of statement of complainant and order dated 26.11.2018, of learned Additional Sessions Judge, Panipat, for granting bail to the co-accused, filed along with the application are taken on record, subject to all just exceptions. Be tagged at the appropriate place. CRM-M-36170-2018 Through this petition under Section 439 Cr.P.C., petitionerParveen, has prayed for grant of regular bail in case FIR No. 0052 dated 11.03.2018 registered under Sections 379B, 307, 365 and 511 IPC at Police Station Sadar, Panipat.
According to the prosecution, on 10.03.2018, the petitioner along with his accomplice, snatched the car of complainant and tried to abduct him, after giving beatings.

CRM-M-36170-2018 (O&M) -2Learned counsel inter alia contends that after recording statement of complainant as PW-1 in Court, co-accused of the petitioner, namely; Kajal @ Priyanka and Sonu, have been released on bail by the trial Court. Since, the bail application of the petitioner was pending before this Court, therefore, he could not apply for bail before the trial Court. The petitioner is in custody since 13.03.2018. Conclusion of trial may take long time. No useful purpose would be served by detaining the petitioner in jail. Thus, treating the case of the petitioner on the same parity as that of his co-accused, namely; Kajal @ Priyanka and Sonu, he may be released on regular bail.
On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Parveen, is ordered to be released on bail pending trial, treating his case on the same parity as that of his coaccused, namely; Kajal @ Priyanka and Sonu, on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
