This petition has been filed, inter alia, seeking a writ of certiorari quashing the order dated 26.9.2005, Annexure P-3, vide which recovery was ordered to be effected from the petitioners on the basis of letter dated 22.08.2003, and further directing the respondents to fix pay of petitioner no.1 at Rs.7900/- with effect from 23.4.1998, and of petitioner no.2 at Rs.8700/- with effect from 1.1.1998, with all consequential benefits.

Learned State counsel contends that the petition has been rendered infructuous since the letter dated 22.08.2003 has been withdrawn by the Finance Department, vide memo dated 05.08.2008 and the order of recovery has been cancelled. She further submits that as the pay of employees affected by the implementation of letter dated 22.08.2003 needs to be restored/refixed, the same shall be done, in case it has not been restored/refixed as yet.

In view thereof, the petition stands disposed of as having been rendered infructuous.
