Petitioner has filed this petition under Section 439 of Criminal Procedure Code, 1973 for grant of interim bail in FIR No.113, dated 21.05.2015, registered under Sections 22, 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Model Town, Hoshiarpur, District Hoshiarpur.
Prosecution story, in brief, is that 115 grams of intoxicant substance was recovered from the petitioner. Learned counsel for the petitioner has submitted that petitioner is in custody since 21.05.2015. Chemical report is still awaited. Learned State counsel who is assisted by Head Constable Ashok Kumar has submitted that petitioner is a habitual offender. In fact petitioner has already been convicted in FIR No.61, dated 10.05.2007, under Section 21 of the Act, registered at Police Station City Hoshiarpur, FIR No.21, dated 03.04.2010, under Section 21 of the Act, registered at Police Station Haryana, District Hoshiarpur and FIR No.166, dated 09.09.1998, under Section 13 of the Gambling Act, 1867, at Police Station Hoshiarpur. Keeping in view the submissions made by learned State counsel, no ground for grant of interim bail to the petition is made out.
Dismissed.
