PANKAJ JAIN, J. (ORAL) Apprehending his arrest in FIR No.140 dated 08.08.2023, registered for offences punishable under Sections 22 of the NDPS Act, at Police Station Garhshankar, District Hoshiarpur, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail. 2.

On the last date, State Counsel on advance notice raised objection w.r.t. maintainability of the present petition in view of the fact that the petitioner was earlier granted interim bail on the ground that the FSL report was still awaited.

Counsel for the petitioner admits that the interim bail was granted to the petitioner on the condition that she shall surrender after the FSL report is received. He thus contends that the petitioner is ready to comply with the said condition however prays that the Trial Court be directed to decide the bail plea of the petitioner expeditiously. Finding it to be a fair request, present petition is disposed off with the liberty to the petitioner to surrender before the Trial Court. In case, the petitioner appears and files application seeking admission on regular bail, this Court is sanguine that the same shall be decided expeditiously in accordance with law.
