This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.108 dated 11.4.2017 registered for the offences under Sections 407 and 120-B at Police Station Chandhat, District Palwal.
Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Haryana appearing for the respondentState and have gone through the record. From the record, I find that as per the allegations 640 bags of Harpal Singh Parmar 2017.09.29 16:37 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-35308 of 2017 [2] sugar, weighing 320 quintals were loaded in the truck on 9.4.2017 morning. The truck of sugar did not reach its destination. It was enquired from the driver of the truck on mobile, who stated that he had stranded in traffic jam near Palwal. After some time, he again tried to contact the driver, but the mobile number of the driver was coming 'switched off'. Later on, he came to know that the truck was stationed at some other place. The present petitioner has been in custody since 25.8.2017. The allegation is regarding misappropriation of sugar bags. The case is triable by the Judicial Magistrate Ist Class. The petitioner, who is in judicial custody, is no more required for any interrogation and investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
