The petitioner seeks the concession of regular bail in a case registered at the instance of Bririnder Singh Sanghere alleging that the petitioner along with others had prepared forged documents and opened an account in the bank. The petitioner allegedly impersonated the complainant whereas co-accused of the petitioners stood witnesses and a loan of Rs.25 lacs was obtained.

Counsel for the petitioner submits that as a matter of fact the petitioner is driver of main beneficiary Gurjit Singh. So far as other coaccused,namely, Budh Singh, Ranjit Singh, Binder Singh and Narinder Kumar Gupta are concerned they have been granted the concession of bail. It appears that the co-accused of the petitioner Gurjit Singh is the main culprit, the petitioner having been used by him by using the fiduciary relationship. Taking into consideration the period of detention i.e. w.e.f. 21.8.2013 and status of the trial i.e. no witness having been examined, the petitioner can be granted the concession of bail. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bond for a sum of Rs. 1 lac with one surety of the like amount to the satisfaction of the trial court subject to the condition that the petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial.
