***** ARUN MONGA, J. (ORAL) Having suffered adverse findings by Ld. Appellate Court in first appeal, filed by plaintiff/respondent No.1 herein, partly allowing the appeal and modifying judgment and decree dated 31.03.2015 passed by Ld. Trial Court, vide judgment and decree dated 12.03.2021, defendant No.2/appellant herein is in second appeal before this Court.

Learned counsel for appellant submits that during pendency of the appellate proceedings, not only the parties have entered into an amicable settlement but the same has been effectively implemented, including execution of sale deed, and nothing survives for adjudication before this Court. 3.

Learned counsel appearing for respondent No.1 accepts the factum of compromise between the parties.

Appeal is accordingly disposed of as infructuous. Parties remain bound to the terms and conditions of the compromise. Execution proceedings if not already withdrawn, shall be withdrawn on the next date of hearing. 5.

Pending civil miscellaneous application, if any, shall also stand disposed of.
