The present petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing the impugned order dated 19.09.2005 (Annexure P-7). 2.

Learned counsel appearing on behalf of the petitioner submitted that in the present petition the prayer of the petitioner was that he has been retired at the age of 55 years, whereas his retirement age should have been extended. He submitted that the present petition is of the year 2005 and the aforesaid grievance of the petitioner with the efflux of time would not survive. He also submitted that so far as the petitioner is concerned, he has already died and the LRs are not coming forward despite being informed for perusing the present case.

After hearing the learned counsel for the petitioner, this Court is of the considered view that when the prayer of the petitioner is for increase in the age of retirement, the present petition is about 19 years old and petitioner has died, nothing would survive in the present petition and the same is hereby dismissed.
