Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.365 dated 16.08.2015 under Sections 148, 149, 323, 324 IPC (Section 326 IPC added later on), registered at Police Station Kharkhoda, District Sonepat.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that the petitioners have already joined the investigation. CRM No.M-35299 of 2015 -2weapons. No injury has been attributed to them. Earlier the FIR was registered under Sections 323, 324 IPC etc. The offence under Section 326 IPC has been added later on. The petitioners were earlier arrested and released on regular bail. The allegation against the petitioners is that they caught hold the complainant. No useful purpose will be served by again sending the petitioners to custody as they have already joined the investigation. The trial of the case will take long time.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioners are entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 14.10.2015 granting interim bail to the petitioners is made absolute.
