**** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the respondents to give compassionate appointment to the petitioner being son of the deceased employee who was working as Headmaster and died while in service on 26.08.1992.

From order dated 03.05.2019, passed by a Coordinate Bench of this Court, it transpires that during pendency of the writ proceedings, petitioner who was seeking compassionate appointment being son of the deceased employee who died in harness, has since expired on 31.01.2017. In view thereof, the widow of the deceased employee i.e. mother of the petitioner and wife of the petitioner were issued notice. Despite service, they have chosen not to appear. 3.
In any case, wife of the petitioner (daughter-in-law) has no right to claim compassionate appointment on account of death of her father-in-law and in all probability widow of the deceased employee i.e. mother of the petitioner would be over age, in any case to prosecute the case. 4.
Dismissed.
