Learned counsel for the petitioner submits that the statutory appeal is pending before the Appellate Authority which may be directed to be decided in a time bound manner and recovery may not be made in the meantime. 2.

At the asking of the Court, Mr. Manipal Singh Atwal, DAG Punjab accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

The appeal is a substantive right of an employee, which is required to be considered and decided within a reasonable period of time. 5.

In view of the aforesaid, this petition is hereby disposed of with a direction to decide the statutory appeal within a period of 3 months. However, till such time, no recovery shall be effected from the petitioner. 6.
