The dispute is regarding possession of a plot within the lal dora of the village. Parties are stated to be distantly related to each other. As per allegations co-accused Jai Chand alongwith his two sonspresent petitioners, are stated to have inflicted injuries on the complainant Dharamvir with jailly and axe blows. Complainant is alleged to have received three injuries one of which is on the vital part of the body.

Learned State counsel on instructions from SI Shyam Lal does not refute the custody period as well as the fact that challan has been presented.
Without expressing anything on the merits of the case, keeping in view the fact that the challan has been presented and the trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioners in custody, the present petition is allowed and petitioners are directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Bhiwani. 28.10.2015.
