******* GIRISH AGNIHOTRI, J. (Oral) The matter has been taken up through video-conferencing on account of restrictions due to outbreak of pandemic COVID-19. Petitioner-Rahul, stated to be aged 19 years, has filed the present petition inter alia with a prayer for grant of regular bail to him in case FIR No.449 dated 10.11.2020 registered under Section 302 of Indian Penal Code (Sections 120-B, 34 IPC added later on), at Police Station Sadar Rohtak, District Rohtak.

Learned counsel for the petitioner, at the outset, submits that petitioner is a young boy of 19 years of age. He then submits that the complainant has alleged in the FIR that when he went to the plot to serve tea to his father at 5.00 a.m., he found the dead body of his father. Notice of motion.

Learned State counsel, on instructions from ASI Pawan Kumar, submits that the challan in this case was presented on 12.02.2021. There are total 20 witnesses and none has been examined till date. Faced with the situation, learned counsel for the petitioner submits that the trial is likely to take some time. In view of the peculiar facts noticed above and the present situation due to COVID-19 and also the fact that trial is likely to take some time, this Court deems it appropriate to direct release of the petitioner on regular bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate concerned, subject to his furnishing bail bonds/surety bonds. However, it is made clear that anything observed herein shall not be construed as an expression on merits of the case. Accordingly, the present petition stands disposed of.
