MADAAN Present:- Mr. Saurabh Kapoor, Advocate for the petitioner. *** After arguing for some time, learned counsel for the petitioner states that he be permitted to withdraw the present petition granting him liberty to raise all the pleas before the trial Court at the time of framing of charge and at any other appropriate stage. However, he has requested that petitioner is an aged woman, who has to travel a distance of more than 160kms to attend the dates of hearing. Permission is granted. The petition is dismissed as withdrawn granting liberty to the petitioner to take all the pleas before the trial Court at any appropriate stage. Further more, the trial Court is directed that on an application having been filed by the petitioner, her personal appearance be exempted subject to the condition that she would be represented by her counsel. Her identity shall not be disputed, and no adjournment shall be sought for the reason of her identification. The trial Court may direct her to appear in the Court, if her appearance is found to be necessary.
