Allowed as prayed for subject to all just exceptions. CWP-9021-2026 1.

The petitioners have filed the instant petition under Article 226 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the impugned order dated 06.09.2022 (P-2) and order dated 24.02.2026 (P-3) adjourning the matter to 13.07.2026. Further, seeking issuance of a writ of mandamus, directing respondent No.6-

-2Educational Tribunal, Punjab to decide the petition No.99 of 2022 in an expeditious manner, if necessary by pre-poning the date of hearing from 13.07.2026 to some earlier date.

While issuing notice of motion on 25.03.2026, the following order was passed:- "The petitioners have filed the instant petition under Article 226 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the impugned order dated 06.09.2022 (P-2) and order dated 24.02.2026 (P-3) adjourning the matter to 13.07.2026. Further, seeking issuance of a writ of mandamus, directing respondent No.6-Educational Tribunal, Punjab to decide the petition No.99 of 2022 in an expeditious manner, if necessary by pre-poning the date of hearing from 13.07.2026 to some earlier date.

Learned counsel for the petitioner, inter alia, submits that the Management is ready to withdraw the charge-sheet dated 07.04.2022, as already stated before the Educational Tribunal vide order dated 09.05.2024 (P3 colly), and consequently, the petition filed by respondent No.5 before the Educational Tribunal shall become infructuous.

Notice of motion.

Mr. N.P.S. Hira, D.A.G., Punjab accepts notice on behalf of respondents No.1 to 3 & 6 and seeks time to get instructions.

Mr. Sanjeev Roy, Advocate has put in appearance on behalf of respondent No.4 and seeks time to file his power of attorney in the Registry.

Let notice be issued to respondent No.5, returnable on 02.04.2026.

Process 'dasti' only.

Additionally, respondent No.5 be served through Mr. Ish Puneet Singh, Advocate representing her before the Educational Tribunal."

Learned counsel for the petitioners submits that the management shall withdraw the chargesheet dated 07.04.2022 within a period of 02 weeks from today with liberty to issue fresh chargesheet, if required, and in this view of the matter, the present petition as well as

-3the petition filed by respondent No.5 before the Educational Tribunal, Punjab, shall be rendered infructuous.

In view of the statement made by learned counsel for the petitioners, the instant petition has been rendered infructuous and the same is disposed of accordingly.
