**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 47 dated 11.5.2018 registered at Police Station Bhindi Saidan, District Amritsar under Sections 306, 120-B IPC.

Counsel for the petitioner contends that petitioner is the brother-in-law. Investigation is over and challan has been presented. The counsel further submits that the petitioner was not living in the same house and the girl had died after four days of the incident in the parents house and it was for the complainant to explain what treatment was given to her during those three days.

The bail application is opposed by the complainant as well as the State counsel. It is stated that the petitioner is named in the FIR and he used to also taunt the girl for not bearing a child. Crl. Misc. No. M-36383 of 2018 -2married to Banti over seven years ago. The petitioner is not living in the same house. The allegations are that the in-laws had administered poison to her and had then taken to a private nursing home. It is mentioned in the FIR that after giving first aid to the girl, the complainant's family took her home and she died after four days.

Considering the above facts and without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
