After arguing for some time, learned counsel for the appellant submitted that the respondent-State had misled the learned Single Judge by stating that the appellant was still facing trial, which was factually incorrect. He submitted that he may be permitted to withdraw the present Letters Patent Appeal with liberty to the appellant to file a review before the learned Single Judge.
