SABINA, J Petitioners have filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in criminal complaint No.16/1.9.2011, dated 27.01.2014, under Sections 302 and 34 of Indian Penal Code, 1860, registered at Police Station Sohana, District Sahibzada Ajit Singh Nagar (Mohali).

Service of respondent No.2 is complete but none has appeared on his behalf.

While issuing notice of motion, following order was passed by this Court on 15.10.2015:- "Learned counsel for the petitioner has

The matter was duly inquired by the police and it transpired that nobody was responsible for this death. Thereafter, respondent No.2 filed a private complaint. In the said complaint, report under Section 202 of Criminal Procedure Code, 1973 was sought and as per report, Annexure P-4, it was opined that the allegations levelled in the complaint were false and baseless.

Notice of motion for 21.12.2015.

In the meantime, petitioners are directed to appear before the Chief Judicial Magistrate and Chief Judicial Magistrate shall release the petitioners on interim bail subject to its satisfaction."

Learned counsel for the petitioners has submitted that in terms of the above order, petitioners have surrendered before the Chief Judicial Magistrate and have furnished interim bail.

Accordingly, interim bail furnished by the petitioners before the Chief Judicial Magistrate in pursuance to the order dated 15.10.2015, is made absolute. Petition stands disposed of accordingly.
