The present petition has been preferred by the petitioner against the impugned judgment dated 05.03.2021 passed by the Additional Sessions Judge, Rohtak, whereby the appeal filed against the judgment dated 12.02.2021 passed by the Juvenile Justice Board declining the regular bail to the petitioner in case FIR No.300 dated 16.07.2020 registered under Sections 302 and 34 of the Indian Penal Code, 1860, (Section 201 IPC was added later on), at Police Station Sampla, District Rohtak, has been upheld. 2.
The record shows that the petitioner was granted interim bail, being juvenile, vide order dated 05.01.2022 by this Court. 3.
Learned counsel for the State has submitted that the trial in this case is almost over. Out of total twenty three witnesses, only three witnesses are left to be examined. In view of the above, it would not be justified to take the petitioner in custody again; for a short duration. Rather, it would be appropriate if his fate is left to be decided along with the decision of the Trial Court.

In view of the above, the present petition is disposed of by making the order dated 05.01.2022 passed by this Court absolute.
