**** AVNEESH JHINGAN, J (Oral) [1] The matter is taken up for hearing through video conference due to COVID-19 situation.

[2] This petition is filed in the nature of Habeas Corpus for release of Harjitpal son of Chanan Lal from illegal custody of respondents No.5 and 6 arrayed in the petition. [3] Notice of motion was issued to respondents No.1 to 3, reply was filed.

[4] Learned State counsel, on instructions from ASI Vipin Kumar, submits that detenu has returned home. She further submits that statement of the detenu and petitioner have been recorded wherein it is stated that detenu at his own went to relative's house and PANKAJ BAWEJA 2021.06.21 16:26 I attest to the accuracy and integrity of this document HIGH COURT, CHANDIGARH

CRWP-5091-2021 came back.

[5] Learned counsel for the petitioner submits that detenu was in illegal custody and badly beaten up. The detenu has returned home, no cause of action survives for pursuing the petition. However, liberty is sought to avail remedies in accordance with law for redressal of surviving grievance, if any.

[6] In view of above, petition is disposed of with liberty as prayed for.
