The petitioner having been summoned as an additional accused in a case registered at the instance of Karambir Singh alleging that on 7.10.2014 the petitioner along with other members of an unlawful assembly, attacked his brother Sukhbir, armed with various weapons, resulting in the murder of his brother, has filed the present petition for prearrest bail. The main allegations are against Malkiat Singh , who had inflicted a knife blow in the abdomen of complainant's brother. So far as the petitioner is concerned, he was declared innocent during investigation. Without expression of any opinion on merits of the case at this stage, it is sufficient to observe that a dual version regarding involvement of the petitioner in the case has already cropped up. The petitioner has already put in appearance before the trial court and has been granted the concession of pre-arrest bail.

The petition is allowed and interim order dated 2.2.2016 is hereby confirmed. The petitioner will remain on bail against the bail bonds already furnished subject to the condition that the petitioner will continue to appear before the trial court and will not absent himself without any sufficient cause February 29 ,2016 ( M.M.S.BEDI ) TSM JUDGE
