ARVIND SINGH SANGWAN, J. (Oral) Petitioner No.1 prays for grant of anticipatory bail in FIR No.0043 dated 04.07.2018, registered under Sections 324, 452, 427, 506, 148, 149 of the Indian Penal Code (in short 'IPC'), at Police Station Hajipur, District Hoshiarpur.
The petition qua petitioners No.2 and 3 stands dismissed as withdrawn vide order dated 04.09.2018.
The operative part of the order dated 04.09.2018, vide which interim anticipatory bail has been granted to petitioner No.1, is reproduced as under:- "....As far as petitioner No. 1 is concerned, learned counsel submits that as per allegations in the FIR, petitioner No. 1 Bachan Lal, who is aged 70 years, has not been directly attributed any injury.
Learned State counsel, on instructions from ASI Namdev Singh, submits that petitioner No. 1 be directed to MOHD YAKUB 2018.12.19 17:17 I attest to the accuracy and authenticity of this document High Court, Chandigarh
CRM-M No.36484 of 2018 appear before the Investigating Officer and join the investigation.
List again on 23.10.2018...."
Counsel for petitioner No.1 has submitted that, in pursuance to the order dated 04.09.2018, petitioner No.1 has appeared before the Investigating Officer and has joined the investigation. Counsel for the State, on instructions from ASI Jagjit Singh, has not disputed the aforesaid fact and submits that petitioner No.1 is no more required for further investigation. It is further submitted that petitioners No.2 and 3 stands arrested. In view of the above, this petition is allowed and the interim bail granted to petitioner No.1 vide order dated 04.09.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
