ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for issuance of directions to respondents No.2 and 3 to take appropriate legal action against respondents No.4 and 5, namely, Jagir Singh and Amrik Singh, who have already been declared proclaimed offenders in cross-case registered under Sections 323/380/506/427/148/149 IPC in FIR No.107 dated 9.7.2012 at Police Station Bullowal, District Hoshiarpur. Reply has been filed by the Deputy Superintendent of Police, Hoshiarpur today in the Court and as per the reply, the aforesaid FIR No.107 was registered on the statement of Parminder Singh against the petitioner Teja Singh, Balwinder Singh @ Manjinder Pal and Komal Saini. The petitioner and Komal Saini were arrested and, thereafter, the challan was presented and the charges were framed by the trial Court. Later on, they were acquitted on 19.3.2019.

Counsel for the petitioner has submitted that the petitioner has submitted an application for which a crossversion case DDR No.21 dated 17.1.2012 under Sections 323, 380, 506, 427, 148, 149 IPC was registered against respondents No.4 and 5 and an enquiry was conducted in SATISH KUMAR 2019.12.06 16:36 I attest to the accuracy and integrity of this document

CRM-M-18767-2019 - 2-- which both the accused were joined the investigation. They were, later on, arrested and the challan in the aforesaid crosscase was presented against respondents No.4 and 5. When they did not appear before the trial Court, non-bailable warrants were issued and they were declared proclaimed offenders by the Illaqua Magistrate on 21.11.2016 and charges were frame against the co-accused. The police of Police Station Bullowal, District Hoshiarpur has conducted several raids to arrest respondents No.4 and 5 but they could not be arrested. It is further submitted in the affidavit that the police is taking all efforts to arrest them and at present there there is no danger to the life and liberty to respondents No.4 and 5. In view of the enquiry conducted by the Deputy Superintendent of Police, Sub Division Hoshiarpur, District Hoshiarpur, the present petition is rendered infructuous and the same is disposed of as such.
