(ORAL) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to count the period of probation followed by regular service rendered by the petitioners for the purpose of pension, gratuity and other benefits in terms of law laid down by a Division Bench of this Court in State of Haryana and others v. Mohinder Kaur and others, 2025 NCPHHC 94672.

Learned State counsel has received instructions from the Department vide memo dated 25.05.2026, which is retained on the case file along with its enclosures as Annexure 'A'. Referring to the same, he submits that the Department has found that the petitioners' claim is admissible as per Mohinder Kaur case ibid. The benefits will be released to them in terms of stipulations contained in the judgment, i.e., after deposit of the employer's share of Contributory Provident Fund (CPF) together with interest accrued thereon at the rate of twelve per cent per annum. In view of the statement made, the petition is disposed of in terms thereof. It will be open for the petitioners to get the due amount of employer's share of CPF with interest adjusted against the arrears of revised pensionary benefits. The second respondent is directed to intimate the due amount to the petitioners within six weeks and release the benefits to them within two months of their depositing/requesting for adjustment of the employer's contribution.
