It is submitted that the brothers have a common compound where the Harvesting Combine Machine is parked which has exclusively come to the share of the petitioner on devolution of shares with his brothers. Since the same is not permitted to be used by his brothers by force, the present petition seeking aforesaid relief has been filed.

After hearing counsel for the petitioner, it is evident that no cause has accrued to the petitioner to invoke the jurisdiction of this Court under Section 482 Cr.PC.

At best he has remedy available in civil law to seek assertion of his rights. As such, no case is made out to direct protection of life and liberty of the petitioner.
