This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 101 dated 19.09.2015 under Sections 306/34 IPC at Police Station Kotwali Nabha, district Patiala.

Learned counsel for the petitioners submits that pursuant to order dated October 28, 2015, petitioner no. 1 (Bhupinder Singh) has joined the investigation. On instructions from ASI, Sahab Singh, who is present in court, aforesaid contention is not controverted by learned State counsel.

In view of the above, order dated October 28, 2015 is made absolute qua petitioner no. 1 subject to the conditions envisaged under Section 438(2) Cr.P.C.

Petition was dismissed at the initial stage qua petitioner no. 2. Investigating officer shall be at liberty to arrest the said petitioner.
