NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Amrik Singh, son of Baldev Singh, resident of village Lakhan Khole Dera, Police Station, Subhanpur, District Kapurthala, who has been booked for having committed the offences punishable under Sections 148, 323, 324, 326, 379-B, 427 and 452 read with Section 149, IPC, in a case arising out of FIR No. 56, dated 11.6.2015, registered at Police Station, Subhanpur, District Kapurthala.

Learned counsel contends that it is a case of version and cross-version; three persons from petitioner's side had received simple and grievous injuries in the same occurrence; PRASHANT KAPOOR 2015.10.20 16:11 I attest to the accuracy and authenticity of this document

CRM-M-35531-2015 the petitioner has been attributed grievous injury by means of Kirpan on the person of the informant/injured, Jagjit Singh, which has cured and Jagjit Singh is performing his daily pursuits; and that further incarceration of the petitioner would not be of any consequence.

Learned counsel for the State on instruction from ASI Manjeet Singh of Police Station, Subhanpur, District Kapurthala, has very fairly admitted that three persons from petitioner's side had received injuries in the same occurrence and that all the offences for which the petitioner has been booked, are triable by learned Judicial Magistrate First Class.

Keeping in view totality of the facts and circumstances of the case, the present petition is allowed. The petitioner, Amrik Singh, son of Baldev Singh, resident of village Lakhan Khole Dera, Police Station, Subhanpur, District Kapurthala, is directed to be released on bail during pendency of the trial of the present case subject to his furnishing bonds to the satisfaction of learned Trial Court/Duty Magistrate.
