The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No.197 dated 20.08.2022 registered under Section 304 IPC at Police Station Dharamkot, District Moga. 2.

Vide order dated 20.04.2023, petitioner was granted the concession of interim bail in the following terms:- "Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the case in hand on the allegations that he along with co-accused had got the deceased addicted to drugs and as a result of overdose of drugs he had died. He further submits that similarly situated co-accused have been extended the concession of interim anticipatory bail vide orders dated 28.03.2023. He further submits that the petitioner is ready to join investigation and cooperate with the investigating agency."

Learned counsel for the petitioner states that pursuant to order dated 20.04.2023, passed by this Court, the petitioner has joined the investigation. This fact is not disputed by the counsel for the State as well. 4.

Learned State counsel on instructions states that the petitioner is no longer required for further interrogation.

In view of the above, the petition is allowed and interim order dated 20.04.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C. It is made clear that in case the petitioner misuses the concession of bail granted to him, the State would be at liberty to seek cancellation of bail granted to him.
