!"# $ Allegations against the petitioner Amritpal Singh @ Amarti in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.71 dated 31.07.2015 registered at Police Station Boha, District Mansa under Sections 324/323/341/34/326 IPC, are that on 31.07.2015 he along with his co9accused had assaulted injured/complainant Kuldeep Singh.

subsequently on addition of Section 326 IPC the present petition has come up and that the alleged injury is on finger, a non9vital part of the body, and has even doubted the credentials of the medical opinion and that the petitioner is in custody since 30.08.2015, which could not be controverted by learned State counsel.
Taking into consideration the submissions made by counsel for the petitioner coupled with the fact that the trial will take a long time to conclude and that petitioner has already joined the investigation, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate.
