RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for issuance of directions to official respondents to conduct fair and impartial investigation in FIR No.0119 dated 08.10.2022 under Section 379 IPC, registered at Police Station Manimajra, Chandigarh, registered by the petitioner against respondent no.7 and further directing to the respondents to arrest the accused.

It has been contended by counsel for the petitioner that petitioner has lodged aforementioned FIR No.0119 dated 08.10.2022, however, since the registration of the same, the Investigating Agency for the reasons best known to it is not proceeding with the investigation. He submits that rather petitioner is being harassed by the Investigating Agency by calling her to the police station time and again. Notice of motion.

On asking of the Court, Mr.Ankur Bali, Addl.P.P.UT, Chandigarh, accepts notice on behalf of the respondents/State and on MEENU 2023.04.25 14:58 I attest to the accuracy and integrity of this order/judgment

CRM-M-20147-2023 -22023:PHHC:057272 instructions from ASI Bhagat Singh, has submitted that Investigating Agency is keenly pursuing the investigation in this case, however, petitioner, who is the author of the FIR, is not cooperating with the Investigating Agency. He submits that as per allegations made in the FIR, the same is against unknown persons and for that Test Identification Parade is also to be carried out by the Investigating Agency but the complainant/petitioner is not cooperating with the Investigating Agency.

Counsel for the petitioner submits that the petitioner would cooperate in the investigation.

After hearing counsel for the parties and going through the file, the present petition is disposed of with a direction to the respondents/Investigating Agency to conclude the investigation within a period of four weeks from today.

It is further directed that the petitioner would cooperate with the Investigating Agency and on the other hand the Investigating Agency is also directed to proceed with the investigation in accordance with law. April 24, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
