(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 66 dated 22.07.2015, registered at Police Station Ghagga, District Patiala, who has been booked for having committed the offence punishable under Sections 304-B IPC/498-A IPC. Learned counsel for the petitioner has referred to CRM-M27022 of 2016 filed by the co-accused, who were released on regular bail by this Court on 12.08.2016 wherein this Court observed that the cause of death was choking, in view of the PMR report wherein the doctor opined regarding the cause of death as choking. Further as per chemical examination report, there was no poison detected in the contents of exhibit.

Learned State counsel on instructions stated that out of 22 witnesses, the chief of 2 has been conducted so far. The petitioner is in custody since 03.08.2015 GAURAV ARORA 2016.10.27 10:29 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-36483 of 2016 -2Keeping in view the fact that the trial is likely to take some time to conclude and the fact that the deceased has died due to choking, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Patiala.
