Through this Civil Writ Petition under Articles 226/227 of the Constitution of India prayer has been made for issuance of writ in the nature of certiorari for quashing impugned order (Annexure P-4). Learned counsel for the petitioner, referring to Rule 19(1) Part IV of the Haryana Veterinary Council Rules, 1988, contends that Government was not authorised to post Dr. Tajender Rana, shown at Sr. No.14 in order Annexure P-4 as Registrar of the Haryana Veterinary Council without its consent. Election of the Haryana Veterinary Council has been declared and is underway. Date of polling is 20.08.2020 which is to be supervised by the petitioner. Thus, at this juncture transfer of the petitioner being politically motivated is illegal. -2CWP No.9499 of 2020 finds the instant writ petition completely devoid of any merit for the reasons to follow.
There is no impediment for the Government to post any Registrar with the Haryana Veterinary Council. Learned counsel for the petitioner has not been able to show that Government is debarred to appoint any Registrar with the Haryana Veterinary Council after declaration of elections.
At this stage, learned counsel for the petitioner prays that he may be permitted to withdraw this petition with liberty to approach the concerned authorities.
