The present petition has been filed for directing the respondents to grant the petitioner promotion as Workshop Instructor Fitting and Plumbing notionally w.e.f. 29.09.2002.

Learned counsel submits that the petitioner had cleared his probation on 29.09.2002, however, he has been promoted as Workshop Instructor, Fitting and Plumbing w.e.f. 18.08.2005, while in the case of similarly situated employee namely Sh. Jaspal Singh, who had cleared his probation, has been granted notional promotion w.e.f. 08.10.1998, the date on which, he having cleared his probation vide order dated 17.03.2020, Annexure P-9. In this regard, a representation dated 17.06.2022, Annexure P-10 followed by reminders dated 17.01.2023, Annexure P12 and 18.07.2023, Annexure P-13, has been submitted by him, which has yet not evoked any response. He thus, at this stage, on instructions, submits that the petitioner is sanguine of it being considered in a positive manner, in case, a direction is given to the respondents to decide the same in a time bound manner by granting him an opportunity of hearing.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the representation dated 17.06.2022 followed by reminders dated 17.01.2023 and 18.07.2023, Annexures P-12 and P-13 respectively, within a period of 6 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon
