The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to grant them ad hoc promotion.

The petitioners are claiming that they played an active role in arrest of four decoits. The official respondents granted benefit of promotion to respondent No. 5 who has not played active role. Nevertheless, they were not granted benefit of promotion 3.

Mr. Ashish Gupta, Advocate submits that role of petitioners was better than the role of respondent No. 5 still he was granted promotion whereas petitioners were denied promotion.

Mr. Raman Sharma, Addl. A.G., Haryana submits that as per applicable promotional Policy, ad hoc promotion is granted to officials for their extraordinary achievement. There is no pecuniary benefit attached to said promotion meaning thereby if a Constable is promoted to the rank of Head Constable, he would continue to get salary of Constable. The rank would be improved which would be ad hoc till securing the substantive rank. Petitioner No. 1 retired on 31.10.2013 on attaining the age of superannuation. Petitioner No. 2 at the relevant point of time was holding rank of Constable and at present is holding rank of Assistant Sub Inspector since 24.06.2014.

The petitioners are claiming that they are denied ad hoc higher rank, thus, have been denied benefit of applicable promotional policy. 6.

The petitioner No. 1 at the relevant point of time was holding rank of Head Constable. If his contention is accepted, he must have been assigned rank of Assistant Sub Inspector. The said rank was ad hoc and no pecuniary gain was attached to said rank. He was subsequently promoted to the rank of Assistant Sub Inspector and thereafter Sub Inspector. He got substantive rank of Assistant Sub Inspector and thereafter Sub Inspector and at this stage it is meaningless to grant him deemed rank of Assistant Sub Inspector from the date claimed by him. Similarly, petitioner No. 2 was holding rank of Constable at the relevant point of time. He was further promoted on the substantive rank of Head Constable and at present holding rank of Assistant Sub Inspector. Grant of ad hoc rank of Head Constable has lost its significance.

In view of the above, the petition stands disposed of as infructuous.
