This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.200 dated 1.8.2018 registered for the offences under Sections 323, 324, 148 and 149 IPC and (Section 326 IPC, which was added later on) at Police Station Division No.8, Jalandhar, District Jalandhar.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. From the record, I find that both the petitioners have been HARPAL SINGH PARMAR 2018.08.30 16:04 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-36634 of 2018 [2] named in the FIR. They were stated to be armed with `Kirpan' and `Khanda'. The grievous injury is not attributed to the present petitioners. They are not required for custodial interrogation. No useful purpose will be served by sending the petitioners to custody. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I accept this criminal miscellaneous petition and in the event of arrest, the petitioners shall be admitted to bail on their furnishing personal bonds and surety each to the satisfaction of the Arresting/Investigating Officer. The petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
