The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.45 dated 14.04.2017 registered for offences punishable under Sections 264/34 of Indian Penal Code (for short, "IPC"), 3/4 of The Punjab Human Trafficking Act, 2008, at Police Station Sadar Jalalabad, District Fazilka. (Offences punishable under Sections 363/370/120-B IPC were added and Sections 34 IPC and 3/4 of The Punjab Human Trafficking Act, 2008 were deleted later on).

FIR was registered on the complaint of Nathu Ram Mehto, whose son aged 07 months was kidnapped from near his hut by Kalu Singh, Ranjit Singh (petitioner) and Nika Singh.

Learned counsel for the petitioner submits that in the initial complaint, it was informed to the police that three unidentified persons have kidnapped son of complainant but in the FIR, which was registered later on, name of the petitioner was disclosed.

CRM-M-36636 of 2018 -2Learned State counsel has argued that recovery of kidnapped child was effected from possession of the petitioner. In her statement as PW-2, wife of complainant has identified the accused as the person, who had picked up her child.

Keeping in view the fact that petitioner has been identified by mother of the child and he is specifically named in the FIR and recovery of kidnapped child was also effected from possession of the petitioner, I find no reason to extend the benefit of regular bail to petitioner at this stage. This petition has no merit and the same is dismissed.
