Learned counsel appearing for respondent No.3 states that firstly the petition is not maintainable before this Court as the impugned order ought to have been challenged before the Court of Sessions by filing a revision, be that as it may, a suit for declaration by way of permanent injunction stands decided in his favour vide judgment dated 06.08.2019, as such the present petition has been rendered infructuous.

On the other hand, learned counsel for the petitioner withdraws the petition to challenge the order impugned before the Court of competent jurisdiction, if required and prays limitation may not come in his way. 3.
