(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.0221 dated 19.07.2017, under Section 326-B IPC, Police Station Division A, District Amritsar (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise dated 16.09.2017 (P-2).
Pursuant to order dated 22.09.2017 of this Court, the parties appeared before the trial Court on 04.10.2017 for recording their statements. Learned Judicial Magistrate Ist Class, Amritsar, has submitted his report vide letter bearing No.468 dated 03.11.2017 duly forwarded by learned District and Sessions Judge, Amritsar, vide Endst. No.10110R SONIKA 2019.03.25 18:09 I attest to the accuracy and authenticity of this document Chandigarh dated 07.11.2017.
CRM-M-35722 of 2017 --2-- According to the report, ld. Judicial Magistrate Ist Class, Amritsar, is satisfied that compromise is genuine, voluntary without any threat or coercion. No accused has been declared proclaimed offender. In compliance of order dated 11.02.2019, original receipts regarding deposit of costs of `20,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of ld. Judicial Magistrate Ist Class, Amritsar dated 03.11.2017 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.0221 dated 19.07.2017 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only. Disposed of accordingly.
