Learned counsel for the petitioner, at the outset, states that impugned order dated 23.08.2014 passed by learned Sub Divisional Judicial Magistrate, Jalalabad (West) (Annexure P2) is a revisable order. Therefore, this petition be permitted to be withdrawn with liberty to the petitioner to avail alternate remedy available to her. It is, however, prayed that the present petition challenging order dated 23.08.2014 was filed well within the period of limitation for filing a revision petition. However, it would be time barred now. Therefore, revision petition to be filed by the petitioner be directed to be heard on merits.

Dismissed as withdrawn.

It is, however, observed that the application for condonation of delay in filing of the revision petition, if filed, shall be considered sympathetically by the appropriate court keeping in view the facts and circumstances of the case.
