(ORAL) After arguing for some time, learned counsel for the petitioner wants to withdraw this petition, however, submits that observation with regard to time i.e. 5.00 p.m. made in the order dated 22.02.2013 by learned JMIC, Mohindergarh, is without any basis and will affect entire case of the petitioner.
Dismissed as withdrawn. Observation with regard to time i.e. 5.00 p.m. shall be taken into consideration only if substantial evidence in the shape of documents i.e duty roster by either party is brought on record.
However, any observation made in impugned order shall not be construed to be an expression on merit for final decision of the pending case.
