Malik, Advocate for the respondent. *** Applicant Mukesh Rani, aged about 31 years, wife of Varun Dev Malik-respondent, presently residing with her parents at Rohtak, on account of matrimonial discord between the spouses, by way of filing the instant application seeks transfer of petition under Section 13 of the Hindu Marriage Act filed by her husband Varun Dev Malik against her having title 'Varun Dev Malik Vs. Mukesh Rani' pending in the Court of District Judge, Jind to the Court of competent jurisdiction at Rohtak. On getting notice, the respondent has appeared through his counsel.

Learned counsel for the respondent states that he has no objection to the transfer of divorce petition to the court of competent jurisdiction at Rohtak but some arrangement with regard to security of the respondent be made, since two days back while respondent was passing through Rohtak, he was chased by brothers and other relatives of the PARVINDER SINGH 2019.10.24 17:19 I attest to the accuracy and integrity of this document Chandigarh

T.A. No. 415 of 2019 applicant having weapons. In that regard a complaint was submitted to Superintendent of Police, Rohtak, where the matter had been compromised. Copy of the complaint and copy of written compromise have been placed on record.

Under the circumstances, the application is accepted. The same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of District Judge, Jind and transferred to Family Court at Rohtak for disposal in accordance with law.

The parties through their counsel are directed to appear in the transferee Court on 18.11.2019. Copies of orders be sent to the Court of District Judge, Jind as well as to the Family Court at Rohtak for information and necessary compliance.

The Superintendent of Police, Rohtak is directed to ensure that no physical harm is caused to the respondent or to his family members or persons accompanying him when he/they go to Rohtak to attend the dates of hearing. A copy of this order be sent to Senior Superintendent of Police, Rohtak also.
