(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 44 dated 10.09.2016, registered at Police Station G.R.P Pathankot, who has been booked for having committed the offence punishable under Section 354 IPC and Section 8 of POCSO Act.

Learned State counsel at the very outset submits that the complainant has given her affidavit that she does not want to proceed further with the case. It has further been informed that Section 10 of POCSO Act has bee inserted in place of Section 8 of POCSO Act. Keeping in view the above fact, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Pathankot.
