***** ARCHANA PURI, J. (Oral) As observed in the order dated 14.05.2025, despite service, none had appeared on behalf of the respondent. Even, on the subsequent dates, none had appeared on behalf of the respondent, even though, the presence of Mr. Rajneesh Malhora, Advocate, has been erroneously marked on behalf of Insurance Company. Even today, none has made appearance on behalf of the respondent. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/463/2024, titled 'Sukhwinder Singh v/s Veerpal Kaur, filed by the respondent-husband, pending in the Family Court, Faridkot and she seeks transfer of the same to Family Court, Gidderbaha, District Sri Muktsar Sahib.

TA-444-2025 (O&M) At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 07.10.2020 and one daughter born from the said wedlock, is in the care and custody of the applicant. However, on account of matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning. The distance between the two places is stated to be 180 kms, up and down.

In view of the aforesaid submissions, more particularly, taking into consideration the fact of the applicant not having any source of earning and above it, the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/463/2024, titled 'Sukhwinder Singh v/s Veerpal Kaur, filed by the respondent-husband, stands transferred from the Family Court, Faridkot, to Family Court, Gidderbaha, District Sri Muktsar Sahib. The requisite record of the aforesaid case be sent by the Family Court, Faridkot, to the District and Sessions Judge, Sri Muktsar Sahib. Learned District and Sessions Judge, Sri Muktsar Sahib, shall assign the said petition to Family Court (Camp Court), Gidderbaha. Even, the parties are directed to appear before the Family Court (Camp Court), Gidderbaha, within a period of one month from today onwards.
